PANUN KAERGAR TERMS AND CONDITIONS

Terms and Conditions govern your use of the services offered by Panun Kaergar through our mobile application and website (collectively referred to as the "Platform"). By accessing or using the Platform and the services provided through it , you agree to abide by these Terms, our Privacy Policy, and any additional guidelines or supplemental terms that may be introduced periodically. The Privacy Policy and Supplemental Terms are integral parts of these Terms, and in case of any conflict, the Supplemental Terms will take precedence.

1. SERVICES

(a) Overview: Panun Kaergar provides a platform that allows users to request services from independent third-party service providers . These services include, but are not limited to, plumbing, electrical repairs, medical emergencies, and towing.

(b) Third-Party Services: The services rendered by Service Providers are independent of Panun Kaergar. While we connect you with these Service Providers, we do not offer or deliver the Pro Services ourselves. Consequently, Panun Kaergar is not liable for the quality, safety, or legality of the Pro Services. Service Providers are neither employees, agents, nor representatives of Panun Kaergar.

(c) Personal Use: The Platform and Services are intended for personal, non-commercial use only. You agree not to engage in any unlawful or prohibited activities using the Platform or Services.

(d) Communication: By utilizing the Platform, you consent to receive communications from us, which may include SMS, email, and in-app notifications regarding your bookings, updates, promotions, and other relevant information. You can opt out of promotional communications through the Platform settings, although this may impact the availability of certain Services.

(e) Identification: In some instances, you may be required to provide identification or verification to access certain Services. Failure to do so may result in the denial of access to these Services.

2. ACCOUNT CREATION

(a) Eligibility: To create an account on the Platform, you must be at least 18 years old. You agree to provide accurate and up-to-date information during registration and to update your account information as necessary.

(b) Account Security: You are responsible for maintaining the confidentiality of your account credentials, including your password. You agree to notify us immediately of any unauthorized access to your account or other security breaches.

(c) Liability: You are accountable for all activities conducted through your account. Panun Kaergar is not responsible for any unauthorized access to your account.

3. USER CONTENT

(a) Posting Content: The Platform may allow you to post reviews, comments, feedback, and other content . By doing so, you grant Panun Kaergar a non-exclusive, royalty-free, worldwide, perpetual license to use, display, modify, and distribute your User Content in connection with the Services.

(b) Content Restrictions: You agree not to post content that is unlawful, defamatory, offensive, or that infringes upon the rights of others. Panun Kaergar reserves the right to remove or restrict access to any User Content that violates these Terms.

4. PAYMENT TERMS

(a) Charges: The cost of the Services will be displayed on the Platform at the time of booking. You agree to pay all applicable charges, including any additional fees for emergency or out-of-hours services.

(b) Payment Methods: Payments for Services can be made through various methods, including net banking, UPI, or cash upon service completion. Panun Kaergar reserves the right to modify or restrict payment methods at any time.

(c) Refunds and Cancellations: Cancellation policies, including applicable fees, will be provided at the time of booking. Refunds, if applicable, will be processed in accordance with our refund policy.

5. CUSTOMER CONDUCT

(a) Respectful Behavior: You agree to treat Service Providers with respect and provide a safe environment for them to perform the Services. Panun Kaergar reserves the right to restrict or terminate your access to the Platform if you engage in abusive, discriminatory, or inappropriate behavior.

(b) Safety Compliance: You are responsible for ensuring that the location where Services are provided is safe and compliant with all applicable laws and regulations.

6. THIRD-PARTY SERVICES

(a) External Links: The Platform may include links to third-party websites or services that are not owned or controlled by Panun Kaergar. We do not endorse or assume any responsibility for the content, privacy policies, or practices of any third-party services.

(b) Third-Party Liability: Panun Kaergar is not liable for any damages or losses caused by third-party services accessed through the Platform.

7. LIMITATION OF LIABILITY

(a) Service Quality: Panun Kaergar does not guarantee the quality, reliability, or suitability of the Service Providers. All Services are provided "as is," without warranties, express or implied.

(b) Liability Cap: To the extent permitted by law, Panun Kaergar's liability for any claims arising from your use of the Platform or Services is limited to the amount you paid for the specific Service.

8. INDEMNIFICATION

You agree to indemnify and hold harmless Panun Kaergar, its affiliates, and employees from any claims, damages, losses, or expenses arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights.

9. GOVERNING LAW AND DISPUTE RESOLUTION

(a) Jurisdiction: These Terms are governed by the laws of India. Any disputes arising from or related to these Terms will be subject to the exclusive jurisdiction of the courts in your city.

(b) Arbitration: Any disputes or claims arising out of these Terms will be resolved through binding arbitration in your city, India, in accordance with the Arbitration and Conciliation Act, 1996.

10. MISCELLANEOUS

(a) Amendments: Panun Kaergar reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting on the Platform.

(b) Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

(c) Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. Panun Kaergar may assign its rights under these Terms without restriction.
